联合国酷刑问题特别报告员对美洲国家滥用单独监禁发出警告

华盛顿特区（2013年3月13日）-联合国酷刑问题特别报告员胡安·门德斯昨日首次向美洲国家间人权委员会发出关于单独监禁问题的简报，呼吁*委员会调查美洲国家的单独监禁做法及其危害影响。

门德斯先生警告，该地区在预防、监测和应对单独监禁使用情况方面缺少保障机制，尤其在拉美地区。他促请委员会努力推动更加强有力的法规应对单独监禁问题。

“尽管许多案例表明，美洲地区在全球滥用单独监禁的趋势中并非个例，但我对该地区整体上缺少单独监禁使用情况的官方信息和数据表示关切。”门德斯先生提到了2011年他向联大提交的全球报告中全面记载的这一普遍做法的危害影响（见下方）。

该特别报告员表示：“仅在特殊情况下才能使用单独监禁，而且只能作为最后的手段，时长应尽可能短。在将其作为纪律制裁时，应经过合理的沟通，提供最低的正当程序保障。”

人权专家回应了委员会关于对青少年和心理残疾者等特殊囚犯实施单独监禁的问题，他强调单独监禁“若用于这类人员，必然构成残忍、不人道和有辱人格的待遇甚至酷刑。”

他呼吁彻底禁止对青少年和心理残疾者实施单独监禁、以及无时限或长期的单独监禁。为了定义构成长期单独监禁的要素，他建议将15日作为基准。

特别报告员认为，“被单独监禁的人员应可随时获得适足的补救，质疑监禁措施的理由和时长，也应能随时获得法律咨询和医疗援助。”

该独立专家特别提到：“各国应推进修订不符合这些标准的立法、政策和做法，这十分重要。”

门德斯先生强调：“尽管在监测和确保美洲地区监狱系统遵守人权标准的问题上，美洲国家间人权委员会和美洲体系发挥着基本作用，但是各国政府也有必要通过国家人权机构或类似机构记录和监测这个问题。”
