联合国专家敦促柬埔寨与国际社会加速对红色高棉的审判

日内瓦（2013年3月14日）-在接受审判的四名被告之一英萨利先生以87岁高龄去世后，联合国柬埔寨人权状况问题特别报告员苏里亚·P·苏佩迪今天敦促柬埔寨法院特别法庭（ECCC）、柬埔寨王国政府、国际捐助者和联合国加速对红色高棉的审判。

苏佩蒂先生表示：“我号召各方，包括整个国际社会重申支持特别法庭完全独立地完成其工作。”并强调：“我们必须为红色高棉政权下幸存的受害者、遇难者家属以及至今饱受红色高棉影响的柬埔寨全体社会伸张正义。”

英萨利先生曾在红色高棉政权统治下的民主柬埔寨政府中担任领导，被指控犯有反人类罪、种族灭绝罪以及战争罪。数十年来，他都成功逃避了针对这些指控的审判。英萨利从1996年叛变以来一直作为自由居民在拜林省过着舒适的生活，直到2007年才根据柬埔寨法院特别法庭逮捕令被捕，直到去世之前一直受到监禁。其夫人英蒂利也是002号案件的被告之一，却已被判定因精神问题不适合审判。

特别报告员表示：“英萨利在审判期间去世意味着他将不能受到最终审判。虽然该案的司法程序可能过于缓慢，但他最终不得不在公开法庭中面对这些严重的指控。虽然事隔30年，司法系统仍能对其问责，这归因于许多人，尤其是受害者坚韧不拔的努力。”

苏佩迪先生指出：“从世界各地的许多其他问责程序案例看来，虽然没有实现最终判决，但英萨利不得不直面对他的指控本身就给红色高棉政权的幸存受害者、遇难者家属以及至今仍饱受红色高棉影响的柬埔寨全体社会带来一定程度的慰藉。”

Professor Surya P. Subedi was appointed by the UN Human Rights Council as the UN Special Rapporteur for Human Rights in Cambodia in March 2009. As Special Rapporteur, he is independent from any government or organisation and serves in his individual capacity. He is currently Professor of International Law at the University of Leeds in the United Kingdom.
