美国中央情报局引渡计划：联合国人权与反恐问题专家寻求真相与问责

日内瓦（2013年3月6日）-联合国人权与反恐问题特别报告员本·艾默生敦促美国与英国政府公布关于乔治·W·布什执政时期中央情报局秘密拘留和审讯行为的保密调查结果。

艾默生先生在一份提交联合国人权理事会的详细报告*中呼吁美国当局“立即并尽可能完整地发布参议院特别情报委员会关于中央情报局秘密拘留和审讯计划的调查报告。” 他还呼吁英国政府公布吉布森调查小组的中期报告，并为由拟议的法官领导的调查和为说明其任务和权力而制定一个时间表。

基于对打击恐怖主义中严重或系统侵犯人权行为的问责原则，独立专家强调：“国际社会迄今未能确保乔治·W·布什总统执政期间中央情报局的某些部门对恐怖嫌疑人采取的酷刑、引渡和秘密拘留行为的全面责任。”

特别报告员还注意到对“其他国家中合谋参与该计划的政府官员的行为”缺乏问责，并就确保关于政府官员在反恐过程中公然或系统侵犯人权问题中的真相权和问责原则向各国提出一系列框架原则建议。

特别报告员强调：“被发现参与了秘密拘留行为的个人以及在拘留过程中有任何非法行径的个人，包括对其下达相关命令、鼓励或默许此类活动的上级负责人都应立即受到起诉。如果判定有罪，应视罪行严重程度量刑。” 报告员还回顾了联合国2010年在《打击恐怖主义背景下与秘密拘留有关的全球做法问题的联合国研究报告》中提出的相关建议。

艾默生先生敦促世界各国政府，尤其是被指称准许中央情报局的引渡航班使用其领空和降落设施的国家，审查国内法律和实践，包括在可能的情况下回顾各自国内当局开展过的调查，以便与他报告中所提出的各项原则相一致。

特别报告员在其建议中呼吁立陶宛、摩洛哥、波兰、罗马尼亚和泰国等政府启动或重新启动 “针对中央情报局在其领土上设立‘黑牢’的可靠指控进行有效独立司法或准司法调查；查明可能授权或合作建立或操纵这些设施的政府官员；发布此类调查的结果并对相关官员的行为进行公开问责。”
