Summary
The study compiles information on existing migration legislation and policies at the national level.
Pursuant to Human Rights Council Resolution 34/21, the Special Rapporteur on the Human Rights of Migrants is mandated "to take into account a gender perspective when requesting and analysing information, and to give special attention to the occurrence of multiple forms of discrimination and violence against migrant women".
In carrying out the mandate, the Special Rapporteur presented to the 41st session of the Human Rights Council a study on the impact of migration on migrant women and girls, which provided an analysis on this issue from a gender perspective (A/HRC/41/38).
The study aimed to contribute to deepening the understanding of migration as a gendered phenomenon and its human rights impact. The Special Rapporteur considered that a greater understanding of the gender perspective of migration could enable States to better protect migrant women and girls from gender-based discrimination, abuses and violations at all stages of migration, as well as to support their empowerment and the fulfilment of their human rights.
To further the efforts in assisting States in this regard, the Special Rapporteur decided to dedicate the report to the 74th session of the General Assembly on good practices or initiatives of gender-responsive migration legislation and policies. The Special Rapporteur was also interested in learning from States any challenges or obstacles they face in their implementation; as well as seek their views on how their efforts could be better supported by other stakeholders to maximise the impact.
