Reprisals

Under article 13 of the Convention, “States parties shall ensure that any individual who alleges he has been subjected to torture in any territory under its jurisdiction has the right to complain to, and to have his case promptly and impartially examined by, its competent authorities. Steps shall be taken to ensure that the complainant and witnesses are protected against all ill-treatment or intimidation as a consequence of his complaint or any evidence given”.

To monitor this provision, the Committee has designated rapporteurs to follow up on any allegations of reprisals under the Convention and adopted a statement on reprisals at its 51st session in 2013 (CAT/C/51/3).

At its 55th session in 2015, the Committee adopted guidelines on the receipt and handling of allegations of reprisals against individuals and organizations cooperating with the Committee under articles 13, 19, 20 and 22 of the Convention (CAT/C/55/2).
