Call for Submissions: legal status of Israeli settlements under the Rome Statute
Objectives
The thematic report of the Special Rapporteur, Mr. Michael Lynk, to the Human Rights Council in its June/July 2021 session will focus on the legal status of the Israeli settlements in the occupied Palestinian Territory under the Rome Statute of the International Criminal Court.
Key questions and types of input/comments sought
To inform his report, Mr. Lynk welcomes contributions from States, local and regional governments, national human rights institutions, civil society organisations, academics, UN agencies and other stakeholders, on any of the following issues:
- What have been the human rights and humanitarian impacts of the Israeli settlements on the Palestinian population in the occupied West Bank, including East Jerusalem?
- What is the legal status of the Israeli settlements under international human rights and humanitarian law?
- What was the history of the drafting of Article 8(2)(b)(viii) of the Rome Statute? What was it intended to prohibit, and why?
- Can you provide examples of the impact that settler-implantation initiatives by colonial powers or alien rulers have had on the self-determination of peoples?
- What leadership or supporting role has the Government of Israel played in the planning, establishment, expansion and maintenance of provided to the Israeli settlements since 1967?
- What has been the role of the Israeli Supreme Court in furthering or constraining the Israeli settlements? Has it applied international law in its rulings on the settlements?
- Are the Israeli settlements in breach of the prohibitions under international criminal law, particularly under the Rome Statute?
- Any other relevant information which would assist the Special Rapporteur in drafting the report.
How and where to submit inputs/comments
Submissions of various lengths are welcomed. Summaries of, and hyperlinks to, relevant documents, statistical data, reports, articles, books, public statements, organizational and state pronouncements are particularly useful.
The SR would appreciate any inputs you may have on this by 30 April 2021.
