Negative impact of corruption

At its twenty-third session, Council adopted resolution 23/9 (A/HRC/RES/23/9) on the negative impact of corruption on the enjoyment of human rights, in which it recognizes the link between anti-corruption efforts and human rights, and the importance of exploring how to better utilize United Nations human rights mechanisms in this regard and requests the Advisory Committee to:

1. submit a research-based report to the Human Rights Council at its twenty-sixth session (June 2014) on the issue of the negative impact of corruption on the enjoyment of human rights, and to make recommendations on how the Council and its subsidiary bodies should consider this issue;

2. seek the views and inputs of member States, relevant international and regional organizations dealing with the issue of corruption, in particular the United Nations Office on Drugs and Crime, the International Anti-Corruption Academy and the Office of the High Commissioner, as well as national human rights institutions, civil society and relevant academic institutions, when preparing the above-mentioned research-based report;

3. take into account, as appropriate, the specific mandate of the Human Rights Council as well as the work done on the issue by competent United Nations bodies and mechanisms within their respective mandates, when elaborating the above-mentioned report.

At its eleventh session in August 2013, the Advisory Committee established a drafting group tasked with the drafting of the report and designated the following experts as members of the drafting group: Mr. Saeed Mohamed Al Faihani, Ms. Laurence Boisson de Chazournes, Mr. Mario L. Coriolano, Mr. Latif Hüseynov, Mr. Alfred Ntunduguru Karokora, Mr. Obiora Chinedu Okafor, Ms. Katharina Pabel (Rapporteur), Ms. Cecilia Rachel V. Quisumbing, Ms. Anantonia Reyes Prado, Mr. Dheerujlall Seetulsingh and Mr. Imeru Tamrat Yigezu (Chairperson), as well as Mr. Shigeki Sakamoto and Ms. Mona Zulficar, whose term ended on 30 September 2013. Subsequently, Mr. Ahmer Bilal Soofi also joined the drafting group.

In line with Council resolution 23/9, requesting the Committee to seek the views and inputs of different stakeholders, the following questionnaires were prepared and disseminated by the Committee in September 2013:

At its twelfth session in February 2014, the Advisory Committee recommended that the Human Rights Council extend the time schedule envisaged to allow for better informed work, inter alia, by analysing the numerous recently received responses to the questionnaire, and that the Advisory Committee be requested to submit an interim report to the Council at its twenty-sixth session and a final report at its twenty-eighth session.

The interim report (A/HRC/26/42) was accordingly submitted to the twenty-sixth session of the Human Rights Council in June 2014 and the Council, by its decision 26/115 (A/HRC/DEC/26/115), extended the time for presentation of the final report to its twenty-eighth session.

At its thirteenth session in August 2014, the Committee took note of the draft report prepared by the drafting group and requested the drafting group to finalize its report to the Council in the light of the discussion held by the Committee at that session. The drafting group therefore finalized its report (A/HRC/28/73), which was submitted to the twenty-eighth session of the Human Rights Council.
